Signs of Corruption and System Failures From The Stories of The Victims of Immigration EnforcemenT
Welcome to the ICE Files:
Angie Rodriguez-#0001
Fled violent persecution in Columbia and has an asylum case. She was re-detained at an immigration check in “even though immigration officials had previously released her from detention after determining that she was not a flight risk or danger to the community“ (1). After ICE placed her in a detention center, petitioner began to feel ill; subsequent testing revealed that petitioner was pregnant. The verified petition asserts that petitioner was not provided with adequate food, medical care, or pre-natal educational materials while detained (1). Angie Rodriguez then suffered a miscarriage (Mesa Verde detention facility). Due process clause was not met in this case. Additionally, the court ruled “the public has a strong interest in upholding procedural protections against unlawful detention, and the Ninth Circuit has recognized that the costs to the public of immigration detention are staggering.” (this also feels like the most inhumane reason, but for some reason was necessary to note in the order).

Jasmine Mooney #0002
"There was no explanation, no warning. One minute, I was in an immigration office talking to an officer about my work visa, which had been approved months before and allowed me, a Canadian, to work in the US. The next, I was told to put my hands against the wall, and patted down like a criminal before being sent to an Ice detention center without the chance to talk to a lawyer.” (1). She restarted the visa application multiple times, returning to Canada when requested. She was suddenly detained for two weeks. At first, detained in a cell left to sleep on the floor. She said, “The real issue was how long it took to get out of the system, with no clear answers, no timeline and no way to move forward. Once deported, many have no choice but to abandon everything they own because the cost of shipping their belongings back is too high” (1). Then, she was transferred to Otay Mesa and then San Luis detention center. This is where she says “we were forced to go through the entire intake process all over again, with medical exams, fingerprinting - and pregnancy tests; they lined us up in a filthy cell, squatting over a communal toilet, holding Dixie cups of urine while the nurse dropped pregnancy tests in each of our cups. It was disgusting” (1). “There were no pillows. The room was ice cold, and one blanket wasn’t enough. Around me, women lay curled into themselves, heads covered, looking like a room full of corpses. This place made the last jail feel like the Four Seasons” (1). She was finally released and shares her story for the women she met and bonded with.

Jackie Merlos- #0003
She has a pending u-visa and no criminal record. She held on the "suspicion of trafficking her sister into the country." Her 4 children were held for multiple weeks and were interrogated without their mother or lawyer present AND as US citizens. After their release to a family friend, Jackie was kept for three additional months for a trial in which she was released but remained wrongfully held after her release and her husband had already been deported. When speaking about her children: "It's stripped some of the innocence, you know, it's terrible." (1).

Jessica Brösche-#0004
A German tourist who travelled to Mexico for a trip then travelled up to the US along with a friend and a valid Electronic System for Travel Authorization. At the point of entry she was detained. Usually, when a tourist is denied entry at a border they are allowed to withdraw their application for entry instead of being subject to deportation proceedings. Her friend said: “‘They took her right in front of me as we were walking over,’ Lofving, a clothing designer based in Los Angeles, told CNN. ‘Two hours passed, and then she called me and said, ‘Hey, I’m gonna get deported back to Germany. I’ll call you from Germany in a couple of days’” (1). “In a phone interview with KGTV last month, Brösche said that she had been kept in ‘horrible’ solitary confinement for eight days when she entered US custody. ‘I just want to get home, you know? I’m really desperate,’ Brösche told KGTV from Otay Mesa. ‘I don’t really understand why it’s taking so long to get back to Germany’” (1). They bought a ticket for her return, but ICE said they needed approval before purchasing the ticket so it was invalid.

US citizen arrested and detained by ICE after ICE ran into his vehicle, “what we learned from this experience is that ICE agents lie to police officers” (1). They told police and 911 that Martinez backed into their car and video shows this is not the case. He was released on pending charges from ICE. (You read that correctly, ICE was proven to lie with no charge against them but they have pending charges against him).

Montessori teacher shot 5 times by a CBP officer after trying to flee from an aggressive car incident. The agent bragged about the shooting to other agents in text. ICE labelled her a domestic terrorist and charged her, in fact this statement is still up on ICE website though charges were dropped. “NPR asked DHS if the agency plans to take down or update their online statements given that charges against Martinez have been dropped. Instead, in a statement to NPR on Friday, DHS reiterated that accusation again…In court testimony, Exum acknowledged that Martinez had not "rammed" him. Martinez has denied doxing federal agents..” (1). Charles Exum, her shooter, has not been fired or charged. Ema Crispín de La Paz-#0008
Street vendor and grandmother who was detained at a Home Depot for four months. She recalls “there she lost weight, being fed meals that sometimes included expired beans or ham, she said. Having been denied access to her medication, she said she felt the need to speak up about her unjust detainment and the conditions at Adelanto.” (1). She said “Her message to such immigrants [ones without criminal records] was to not sign documents to authorize deportation. The $1,000 “exit bonus” promised by the Department of Homeland Security is used to secure their flight out, she said, often leaving migrants with a few hundred dollars if they sign.” (1). While in Adelanto, she said she prayed daily -often with other detainees- asking for strength and fortitude. She saw women get sick, she said, because they were deprived of medication or had become depressed, or fainted. One young Venezuelan attempted to kill herself, De Paz said. Some days, she said, she lost hope that she would ever get released. She says she applied for immigration legally, but the attorney turned out to be a scam.

Jorge Retes-#0009
A Veteran US citizen who was forcefully detained by ICE (agent kneed on his neck and back) and not provided a lawyer even after multiple requests. Upon detention, he was put on suicide watch and held in isolation. He missed his daughter's third birthday. ICE claimed he “became violent and refused to comply with law enforcement. He challenged agents and blocked their route by refusing to move his vehicle out of the road. CBP arrested Retes for assault” (2). Retes: “My first night in jail, my hands were burning from the pepper spray and tear gas because I was never allowed to wash them off” (3). “This isn’t just my story. It’s a warning. Because if it can happen to me, it can happen to any one of us.” (3).

Antonio Aguilar Moldonano-#0010
A 26 year old recent mother whose case has drawn attention in part because she is a lactating mother to a 22-month-old nursing toddler, and her attorneys say jail staff initially did not provide her a breast pump, leading to her milk turning green (2). She has been following the rules for an active asylum case and was arrested for over three weeks due to an old removal order. After she was released on $10,000 bond, DHS filed an automatic stay which was denied due to ICE's internal policy from the Biden administration for nursing and pregnant mothers. Judge stated, 'In the court's view, the irreparable harm to separating a nursing mother and her child is self-evident.'

Cary Lopez-Alvarado-#0011
Arrested by ICE at nine months pregnant for obstruction (think about how serious a crime should be to be arrested this far along in a pregnancy and watch the video where she gets arrested- the child in her belly is also worthy of protection). “Alvarado says she was handcuffed and detained for over eight hours with a chain around her belly. Once she was released, Alvarado says she went straight to the hospital with cuts and bruises. She was also already in labor” (2).

Jose Paniagua Calderon-#0012
Multiple videos of witnesses allegedly show ICE running over Calderon’s legs after detaining him. “Multiple eyewitness videos of Paniagua Calderon's detention on Dec. 4 show ICE agents smashing the window of his car, dragging him out and throwing him to the ground. The videos appear to show an ICE agent then running over his legs with a vehicle, according to Indivisible Greater Vancouver. Paniagua Calderon was offered no medical care at the scene, the group said” (1). ICE claims this event was theatre and x-rays after the fact showed no broken bones. “Washington law and police department policy required Vancouver police to open a traffic crash investigation. It said it contacted the ICE Office of Professional Responsibility but was told because it was an open investigation, it could not provide officers with any information” (2). After his release, “he also complained of being detained in cold rooms without blankets; losing weight due to constant hunger” (1). He is legally here.

Daryn Herzberg-#0014
Veteran tackled from behind sustaining injuries and showing ICE used excessive force. Herzberg said one of the agents in that incident told him, ‘You’re not talking s**t anymore, are you?’” (1). ICE claimed in a statement that he is known to assault officers, Herzberg says they are lying. (At the very least this is excessive force and assault by the agent.)

Carlitos Richard Parias (Richard LA)-#0015
Parias was indicted on assault on a federal officer “A federal judge dismissed the indictment against TikTok creator Carlitos Richard Parias, citing government failures to release body camera footage and a violation of the defendant's right to counsel) (1). Parias was shot in the arm, and federal officers used excessive force shown in video evidence. Despite dismissal of charges he was kept in a detention facility as an alleged illegal alien. Feel free to look at the lies in article 3 including that he used his - in fact this statement is still posted to DOJ despite it being proved false on body cam footage. (Please note, these officers using excessive force, are the same officers being backed by this administration. This case did not end in a human rights case, it ended with wrongful charges and the victim was forced to be the defendant- like most other cases.)

Bayron Rovidio Marin-#0016
“Federal immigration agents surveilled Bayron Rovidio Marin in his hospital bed for 37 days without charging him after a Carson car wash raid. A federal judge ordered officials to remove guards and restraints, saying the government failed to prove he violated any law or posed a flight risk. Marin was under 24/7 surveillance, couldn’t speak privately with doctors or lawyers, and was interrogated while medicated and in pain.” (1). Bayron broke his leg in this raid and was monitored and not allowed a lawyer for 37 days. Despite ICE holding him for a month they failed to provide any evidence that he had broken any law or was a flight risk. He was illegally detained, and the judge ruled that he shall not be illegally detained again.

Has a pending asylum case, work permit and never missed a check-in. He was taken “on the basis of his perceived ethnicity” (1). He admits “in light of his limited English fluency, he may have signed a voluntary deportation document mistakenly thinking that the document concerned releasing him on bond” (1). It was found “the public interest served by deporting Hakan K. is outweighed by the interest of the public in ensuring due process, judicial review, and the rule of law” (1). The court order of his immediate release was violated January 24th as cited by Minnesota Chief Judge P. Schiltz.

Fei and Yuanxin Zheng-#0021
Father and his 6 year old son detained at an immigration check in. His son was separated from him upon detention and he and his lawyer claim they could not find where he was being kept for days. “The case appears to be an example of a tactic that the Trump administration has used to pressure immigrants in the U.S. illegally to leave by separating them from their families after they refuse to comply with deportation orders” (2). The Trump administration claims they were separated after refusing to board a deportation flight, “Gao said that his client had refused to board an ICE flight to China in September because he was fearful of facing government retribution for fleeing the country” (2). “Spector said that while Zheng was at the detention center and away from his child, he decided to stop fighting his immigration case and comply with a deportation order because he wanted to be reunited with his son” (1). He was finally re-united with his son upon deportation.

Released with this statement: “Elizabeth and her mother should never have been detained, he said: ‘This didn’t have to happen. This is a family going through the process as it was intended. They presented at the border as asylum seekers and were admitted to the country’” (1). DHS officers claim “She failed to find a trusted adult to care for the child, so officers kept the family together for the welfare of the child” (1) “That account is contradicted by the assertions of her family and school officials who said the father was ready to take custody” (1).

A 22 year old mother to a newborn, detained on her way to the NICU 15 days after birth to a NICU baby. She has no criminal record and has an active asylum case. She was held in a holding cell for 34 hours without a bed or blanket. Days later, a judge said he found the accounts “highly credible,” and described the conditions as “unnecessarily cruel.” “Guzmán said that prior to her arrest, she was at the hospital daily, and would often get time ‘piel a piel,’ or skin-to-skin, with her daughter. While in custody, Guzmán had no access to any information about her daughter” (1). “There is no active deportation case against Guzmán, and her visa application is still pending. She keeps having flashbacks to her arrest and detention: the sound of chains and handcuffs being thrown around by immigration agents, the screaming, the way the men arrive at the detention facility ‘all beat up and dirty.’” (1). #Pregnant&Postpartum #InadequateConditions #Released #SolitaryConfinement/Restraints

Lopez Gomez briefly remained in custody of the jail after ICE requested, but this case encouraged media response since ICE is not usually allowed to get involved in cases with citizens. "’No one should be arrested under that law, let alone a U.S. citizen,’ said Alana Greer, an immigration attorney from the Florida Immigrant Coalition. ‘They saw this person, he didn't speak English particularly well, and so they arrested him and charged him with this law that no one (should) be charged with.’" (1).

Multiple unmarked vehicles surrounded and blocked Ms. Ramirez Sanan’s car, which had a clearly visible disability placard hanging [for 13 year old autistic son] from the rearview mirror. Within moments, at least eight armed and masked officers- without identifying themselves or giving the passengers a chance to cooperate or provide identification- swarmed Ms. Ramirez Sanan’s car and smashed her driver-side windows. Ms. Ramirez Sanan was covered in shards of glass. ICE officers then forcefully pulled Ms. Ramirez Sanan, who is 50 years old, from the car. In a shocking display of lawlessness, the officers then violently arrested Ms. Ramirez Sanan, a lawful immigrant, by forcefully twisting her arms back to handcuff her, kicking her, and smashing her against the ground face-first, all in front of her terrified children.” (1).

A Syrian-born Palestinian and a permanent legal resident of the United States arrested by ICE and held in Louisiana detention facility. “Rather than charging Khalil with a crime, the Trump administration attempted to deport him based on a pair of seldom-used provisions of the Immigration and Nationality Act, Section 1227(a)(4)(C) and Section 1182(a)(3)(C). Together, these provisions authorize the Secretary of State to render a noncitizen deportable if he ‘personally determines’ the person’s ‘lawful’ activities are compromising a ‘compelling foreign policy interest.’ … it allows the government to turn lawful expression into a deportable offense” (2). Over six months into his detention, “a federal district court held that the administration’s targeting of noncitizens for deportation based on protected speech violated the First Amendment” (2). He missed the birth of his first child after being denied temporary leave.

Rumeysa Öztürk-#0037
“masked federal agents ambushed pro-Palestinian Tufts University student Rumeysa Ozturk, a Turkish citizen with an F-1 student visa, on the streets of Boston. Agents threw Ozturk into a van and transported her thousands of miles to a remote Louisiana detention facility. Unbeknownst to Ozturk, DHS had revoked her visa days prior without telling her” (2). ICE claims it was due to ties with terrorists, “the unsealed records show officials acknowledged Ozturk's visa revocation was based solely on her co-authorship of an op-ed in Tufts' student newspaper” (2).

“The complaint alleges that Customs and Border Protection, which detained and deported the family last month, committed ‘serious abuses’ when it denied medical care to the 10-year-old girl, detained U.S. citizen children ‘in deplorable conditions’ and removed them to Mexico, “where their lives are in peril because of their status as U.S. citizens,” among other claims. The children are US citizens, but the parents are not, this follows the 10-year old’s brain surgery.

Sergio Ramirez-#0040
“Was detained for three months before he decided to self-deport to Mexico at the advice of his lawyer, he said.” (1) even though he had a work permit. “For months, he slept on a steel bed, ate canned food and couldn’t change his clothes.” They believe there was a delay in processing his work visa that lead to this but he is still married to a US citizen and has no criminal record.

According to multiple reports and video, the 76 year old man was stopped and detained despite repeatedly telling agents he was a U.S. citizen and showing them proof of his identity. During the arrest, agents allegedly slammed him to the ground, kneeled on him, and beat him so severely that he suffered multiple broken ribs and a collapsed lung. He was hospitalized for his injuries. The man’s family says the incident was completely unjustified and that he had committed no crime. They also stated that Border Patrol held him for hours without providing medical care, even though he was visibly injured and struggling to breathe. The family has since filed a legal claim accusing the agency of excessive force, unlawful detention, and violating his civil rights.

Jaime AlanÃs-#0042
56-year old Mexican farmworker died after falling in attempts to flee immigration agents. DHS was not in pursuit of Alanis in this raid. “Relatives say Alanis García, like so many immigrants, always wanted to return home to his family. His distraught widow, Leticia Cruz Vázquez, wailed, ‘I didn’t want him like this!’ before fainting.” (1)

Daniel Rascon-#0043
A legal US citizen accompanying his father in law (Fransisco Longoria- was later arrested and charged by federal authorities, who alleged he had assaulted immigration officers with his truck during the incident. Longoria’s attorneys said he drove off because he feared for his safety. The charges were dropped a month later.-3). After a violent traffic stop where agents shot at the vehicle, US citizen Rascon testified to this incident in front of congress. (source 1 has a video of part of the incident with officers breaking the window).

Jean Wilson Brutus-#0044
Brutus died in Delaney Hall detention center. "In its news release about Brutus's death, ICE also focused on Brutus's history of minor trespassing arrests, labeling him a 'criminal alien.'" (2). "ICE's belated report of an urgent tragedy caused by its inhumane conditions and cruel neglect, and its defamation of the deceased to justify a death on its watch, has all the obvious signs of culpability and cover-up." (1). "'He had a legal asylum application that was in progress,' Champagne said. 'Being in custody of an official does not negate one's right to life, the right to medical care, and the right to dignity.'" ICE states the cause of death is unknown with a delay in the news to family and has not allowed an independent autopsy to date (3 months later).

Ge Chaofeng-#0045
“Police arrested Chaofeng in January for fraud after he participated in a gift card scheme, Yanfeng said. After he finished a short sentence in jail, Immigration and Customs Enforcement took Chaofeng into custody on July 31 to begin deportation proceedings.” Four days after being transferred to a for-profit detention center, Chaofeng was found hanging from a torn sheet in a shower stall. “The autopsy report by a Pennsylvania coroner obtained by Scripps News is much more detailed. It lists suicide by hanging as Chaofeng's cause of death and also says, ‘he was found with his hands and feet tied behind his back.’" (1). His family does not understand how he did this with his hands and feet bound. Three months later they are still requesting information, to which ICE will not release other information, no investigation has been done either.

Julio César Peña-#0046
Romero has no criminal record. “Peña came to the United States from Mexico in sixth grade and has an adult son in the U.S. military. The 43-year-old has terminal kidney disease and survived a heart attack in November. He has trouble walking and is partially blind, his wife said. He was detained Dec. 8 while resting outside after coming home from dialysis treatment.” (2). Initially, Romero was able to find her husband through the ICE Online Detainee Locator System. She would bring his medication, but then he was hospitalized, and denied seeing her husband at the detention facility. After days of trying to find him, they received a call with his location (hospital). “When they got there, they found Peña intubated and unconscious, his arm and leg still handcuffed to the hospital bed. He’d had a severe seizure on Dec. 20, but no one had told his family or legal team, his attorney said” (1).

Hanne Daguman-#0047
A Norwegian woman detained at her green card interview, her husband had to advocate persistently to ensure she had access to insulin. The food mostly consisted of things like pasta, bread, etc which are dangerous to her. She was detained for 9 days before she was released with an ankle monitor until a judge ruled to remove this ankle monitor. She said "I was neglected in jail and the fact my life was put in danger over basically nothing, is really unfair" (2) and "The mental aftermath is also really tough, like I still have nightmares almost every night" (1).

Maria Isidro-#0048
Her daughter described ‘My mother is a Christian woman. A preacher’s wife. A caregiver. A woman with no criminal record, who’s always done things the right way. She showed up to every appointment. She trusted the system. And still, she was taken from us.’ She was detained due to an order of removal in 2004. She and her family claim they have been meeting with DHS for years to ensure she goes about it the right way. This is supported by a I-130 filed in 2023 to support her legal case for status. She said this on the flight to the detainment center: “On the flight, which also included pregnant women, detainees were only allowed to use the bathroom once, had little food or water, and remained shackled, Maria told the paper. She said she’s fearful for the others who were also deported.” (1). She claims she was not given access to medication as a diabetic, DHS claims otherwise (the lack of transparency has left everyone to wonder what is true).

Detained at the Hyundai raid, along with over 200 others. “We were told that a crackdown may take place in the morning, but we didn’t think much of it because we didn’t think we had any problems with our visa,” (1). “Suddenly, at some point, people were being taken away without any explanation. We were only made aware of what was going on after we met the lawyers and consular officials.” (1). “No one would have really wanted to stay," when asked about the alleged last-minute offer to allow the workers to remain at the factory site if they wished.
